MCD has claimed in an affidavit that it can treat an encroached road as 60 feet wide for notifying it for the purpose of allowing commercial activities.
NEW DELHI: Exposing its double standards in enforcement of laws, MCD has claimed in an affidavit filed in the Delhi High Court that it can treat an encroached road as 60 feet wide for notifying it for the purpose of allowing commercial activities where as in reality just 30 feet of the road is available to pedestrians due to construction of about unauthorised 100 shops and houses on the other half.
The affidavit filed by MCD in a case pertaining to encroachment of road facing Punjabi Market in Chand Nagar area of Tilak Nagar, goes on to defend its skewed standards and said: "There is no malafide on part of MCD in showing this road to be 60-feet-wide, where as in reality it is only 30 feet at present." The statement on oath comes despite an order by L-G to restore the roads width to 60 feet even if it required razing illegal structures or acquiring land. A division Bench of Chief Justice M K Sharma and Justice Hima Kohli has now ordered to get cracking and make (for the time being) 45 feet road available to harassed residents. "We direct that MCD should take all necessary steps for removal of unauthorised constructions from the road in question for making available a 45 feet wide road...," HC said. The direction came in connection with a plea filed by Anjana Gosain on behalf of Chand Nagar RWA. The court said: "On what basis has MCD issued the notification (for mixed land use) which as per its statement and the judicial order passed in the writ petition is less than even 45 feet?"
